1. Acceptance of terms
By accessing or using the Gorila Fitness website, requesting a quotation, accepting a quotation, placing an order on the website, placing an order manually by email, phone, invoice, purchase order, or any other off-site method, or otherwise purchasing products or services from Gorila Fitness, you agree to be bound by these Terms of Use, our Privacy Policy, and any additional policies, quotations, invoices, approvals, product descriptions, shipping terms, warranty terms, or written purchase documents we provide.
2. Scope of application
These terms apply to all transactions with Gorila Fitness, including website orders, manual orders not placed through the website, quoted commercial projects, custom fabricated products, flooring packages, gym outfitting projects, deposits, staged deliveries, split shipments, special orders, and made-to-order equipment.
3. Eligibility and authority
You represent that you are the age of majority in your jurisdiction and, if acting on behalf of a company, organization, school, gym, municipality, or other entity, that you have full authority to bind that entity to these terms and to any quote, invoice, purchase order, or related transaction documents.
4. Quotes and manual order acceptance
Quotes issued by Gorila Fitness are invitations to contract and may be revised, withdrawn, or expire unless expressly stated otherwise in writing. A quote is deemed accepted when a customer signs or approves it, confirms acceptance by email or message, remits a deposit, makes full payment, issues a purchase order, requests that production begin, or otherwise instructs Gorila Fitness to proceed. Once accepted, the customer is deemed to have reviewed and accepted the quote, the products listed, the configurations selected, dimensions, finishes, pricing, estimated lead times, shipping structure, delivery assumptions, and these Terms of Use.
5. Customer responsibility for accuracy
The customer is responsible for ensuring that all information provided to Gorila Fitness is complete and accurate, including shipping addresses, measurements, layout requirements, delivery restrictions, access limitations, contact details, product selections, staging priorities, billing information, and any deadline-sensitive requirements. Gorila Fitness is not liable for costs, delays, or performance issues arising from incomplete, inaccurate, or changing customer information.
6. Orders, deposits, and payment
All orders are subject to acceptance by Gorila Fitness. We may require full payment, a deposit, progress payments, or other billing milestones before production begins or before goods are released. For manual or quoted orders, payment terms may be set out in the quote or invoice. Failure to pay any amount when due may delay production, suspend work, postpone shipment, or result in cancellation of the order.
7. Pricing and correction of errors
Gorila Fitness reserves the right to correct clerical, technical, typographical, freight, specification, or pricing errors at any time, including after a quote is issued or an order is submitted. If a material error is discovered, we may cancel the transaction or issue corrected terms for approval before proceeding.
8. Production lead times
All production and shipping timelines are estimates unless expressly guaranteed in writing. For larger project orders, outfitting jobs, flooring packages, or commercial orders involving multiple items or fabrication stages, production may take up to 12 weeks or longer depending on order complexity, quantity, current production load, supplier availability, freight coordination, and finishing requirements. In many larger projects, Gorila Fitness aims to have approximately 80 percent of the order ready within about 8 weeks, with the balance potentially requiring additional time. We strive to deliver as much as possible within that earlier production window, but readiness of part of the project does not mean the entire project is complete.
9. Shipment structure and split shipments
Unless otherwise agreed in writing, Gorila Fitness may hold completed items and ship the order when the full project is complete. If a customer requires part of the order earlier, including for example flooring, racks, or other priority items needed before the rest of the project, that request must be raised before or at the time of quote acceptance. Split shipments, staged deliveries, partial releases, special packaging, or separate freight coordination may be available at additional cost. The customer is responsible for all added freight, handling, storage, and coordination charges associated with such requests.
10. Fixed deadlines and project planning
If the customer has a fixed opening date, construction milestone, installation date, event date, or any other hard deadline, the customer is responsible for planning appropriate buffer time and for communicating that requirement in advance. Estimated lead times are not guarantees. Customers with inflexible deadlines should expect that accelerated coordination or split shipping may be necessary and may result in additional charges.
11. Status updates during production
To reduce confusion and avoid inaccurate assumptions during manufacturing, Gorila Fitness does not provide routine status updates during production unless we determine an update is necessary or unless otherwise agreed in writing. Customers agree that production may proceed with minimal interim communication. We may provide occasional milestone updates at our discretion, but repeated requests for updates do not create an obligation for continuous reporting and do not change any estimated lead time.
12. Changes after approval
Once an order or quotation is accepted, changes to product selection, layout, dimensions, finishes, quantities, accessories, freight structure, shipping address, or delivery timing may not be possible. If Gorila Fitness agrees to any change, it may result in revised pricing, revised lead times, administrative fees, engineering fees, or a restart of part of the production timeline.
13. Custom and made-to-order products
Custom, fabricated, commercial, made-to-order, and special-order products are generally non-cancellable, non-returnable, and non-refundable once approved for production, except where required by applicable law. The customer is solely responsible for reviewing all details before giving approval.
14. Shipping, delivery, and site readiness
Delivery dates are estimates only. The customer is responsible for ensuring that the delivery location is accessible and suitable, including adequate receiving staff, unloading capacity, access paths, and any equipment or site conditions necessary to accept the shipment. Additional charges may apply for missed deliveries, re-delivery, delayed acceptance, remote delivery locations, inside delivery, liftgate service, storage, restricted access, or any special handling requirement.
15. Inspection and claims
The customer must inspect all goods promptly upon receipt. Visible damage, shortages, or packaging concerns must be noted at delivery and reported promptly with supporting photographs and documentation. Failure to inspect and report issues within a reasonable time may limit available remedies.
16. Storage and delayed release
If an order is complete or substantially complete and the customer is not ready to receive it, fails to provide accurate delivery information, delays acceptance, or requests that it be held, Gorila Fitness may store the goods at the customer's risk and may charge storage, rehandling, and re-delivery fees.
17. Returns and exchanges
Return eligibility for standard products, where applicable, is subject to Gorila Fitness return rules in effect at the time of purchase. Approved returns may be subject to inspection, restocking charges, and return freight. Custom, installed, used, damaged, special-order, commercial, or made-to-order items are not eligible for return unless required by law or approved by Gorila Fitness in writing.
18. Warranty
Warranty coverage is limited to the express warranty provided by Gorila Fitness for the applicable product. Warranty coverage does not apply to misuse, abuse, improper installation, improper storage, unauthorized modification, ordinary wear and tear, cosmetic wear, damage caused by carriers or third parties, or use outside the intended purpose of the product.
19. Disclaimer of warranties
Except for any express written warranty provided by Gorila Fitness, the website, products, services, quotations, and related materials are provided on an as-is and as-available basis, without any representation, condition, or warranty of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, durability, title, or non-infringement.
20. Limitation of liability
To the maximum extent permitted by law, Gorila Fitness shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, project delay costs, contractor costs, scheduling losses, substitute equipment costs, storage costs, or reputational harm arising out of or related to the website, any quote, any production timeline, any shipment timeline, or any order. Gorila Fitness's total aggregate liability for any claim shall not exceed the amount actually paid to Gorila Fitness for the specific goods or services giving rise to the claim.
21. Chargebacks and disputes
You agree not to initiate a chargeback or payment dispute without first contacting Gorila Fitness and giving us a reasonable opportunity to review the issue. Quote approval, deposits, partial payments, production commencement, partial shipment, or goods made available for delivery may all be used as evidence of authorization and transaction acceptance.
22. Force majeure
Gorila Fitness is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including supplier delays, material shortages, freight disruptions, border delays, labor shortages, severe weather, equipment breakdown, fire, flood, utility outages, cyber incidents, governmental action, pandemics, or other force majeure events.
23. Intellectual property
All text, graphics, photographs, logos, product names, product designs, layouts, and other content on the site are owned by Gorila Fitness or its licensors and are protected by applicable intellectual property laws. No content may be copied, reproduced, republished, or exploited without prior written permission.
24. Prohibited uses
You may not misuse the site, attempt unauthorized access, scrape data without permission, interfere with site functionality, misrepresent your identity or affiliation, or use the site or our materials for any unlawful purpose.
25. Changes to these terms
We may revise these Terms of Use from time to time by posting an updated version on this page. The version in effect at the time of your quote acceptance, order placement, or payment will apply to that transaction unless applicable law requires otherwise.
26. Governing law and jurisdiction
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these terms, the website, any quotation, or any order shall be submitted to the competent courts of Quebec, subject to any mandatory consumer protection rights that may apply.
